Support to Provincial Law Making Process
With the purpose of helping the provinces to formulate their laws as per the Article 235 (2) of the Constitution, the NLS – with the support from The Asia Foundation - has been organizing programs.
Earlier, the NLS had also worked providing technical support to OPMCM and the parliament for the formulation of the Federal, Province and Local Level Coordination Act as per the Article 235 (1). The law is currently in force.
As a follow up to this initiative, the NLS is now working with the provincial Assemblies and the governments to provide support for the formulation of law as per the Article 235 (3).
The Article235 (2) states that the province assembly shall coordinate with the concerned rural municipality, municipality and district coordination committee in order to maintain coordination and resolve disputes among province, rural municipality and municipality. The Article 235(3) allows provincial government to enact necessary legislation for the fulfilment of the objectives set forth in Article 235(2).
In this connection, the NLS mobilized its experts to prepare a draft of Province-Local Level Coordination Bill and organized consultation programs in all seven provinces by inviting concerned stakeholders. Two provinces – Gandaki and Sudur Paschim – have already passed the Bill, enacted law and are in operation now.
